The Judicial Council can dismiss complaints for various reasons as set out in the Judicial Commissions Act 2024 including the following.
The complaint being dismissed if the Council is satisfied on reasonable grounds that:
- the complaint is not within the jurisdiction of the Council; or
- is frivolous, vexatious or lacking in substance.
- the subject matter of the complaint is trivial; or
- happened so far in the past that it does not justify further consideration.
The complaint can also be dismissed if, in relation to the matter complained about, there is or was:
- another satisfactory means of redress or of dealing with the complaint or the subject matter of the complaint; or
- an existing appeal or review right in respect of the subject matter of the complaint that appears to be adequate to deal with the complaint or the subject matter of the complaint.
Please note that in deciding whether to dismiss a complaint, the Council may have regard to any matter that the Council considers relevant. In addition, complaints can be partially dismissed by the Council.
